A foreigner could marry a Thai, or another foreigner in Thailand. Thailand’s allure to foreigners as the perfect wedding locale must be from its pristine island beaches, the exotic jungle destinations, the colorful city, historic attractions, or perhaps the concept of the traditional Thai wedding. Apart from the wedding ceremony, here’s how a foreigner can legally register for marriage in Thailand.
Like any other special occasion, marriage takes a lot of preparation. If you are planning to get married in Thailand, you need to be familiarized with several processes and legalities it entails. Securing legal assistance from a local attorney is the best way to ensure that your marriage carries weight in Thailand and abroad, and guarantee compliance to Thai legal parameters. This may sound tedious at first, but rest assured that you’ve done much of the legwork. After all, you’ve already found love, that’s supposed to be the hardest part.
The marriage will only be recognized under the law of your home country if it is valid under Thai law. In other words, simply having a ceremony in Thailand doesn’t mean you are legally married.
It is very possible to complete the process of getting the correct documentation together in one day. However, it is advised to leave a two-day window aside to complete the process just in case you run into a problem.
Whether you are a foreign national marrying a Thai national, or a foreign couple coming to Thailand to get married, you will need to jump through a few hoops before you can legally register your marriage.
Foreigners who are wishing to marry shall appear in person with their respective passports and arrival card at their Embassy in Thailand to complete a declaration called “affirmation of freedom to marry” attesting that you are single and free to marry in accordance with Thai Law. This affirmation is impossible to obtain from your country of residence in advance. The registration shall be effected by a Thai Diplomatic or Consular Officer. You need to take the completed declaration to a reputable translation office to have the contents of the declaration translated into Thai.
Then, the documents together with translation and copies of passports have to be taken to the Legalization Division of Consular Affairs Department, where the Consular Official’s signature will be authenticated. This normally takes two days. These documents and translation are then ready for submission to a District Office, known as an ‘amphur‘ or ‘khet‘, where the District Registrar will register the marriage and issue the marriage certificate in Thai in accordance with and following the procedure led down in Thai Law.
This application can be filed at any District Office or Minor District Office nationwide regardless of the birthplace of the couple.
A marriage can take place on a declaration made by both the parties intending to marry by giving consent to take each other as husband and wife publicly before the registrar in order to have it recorded by him. Giving consent to the marriage may be made by:
- Affixing the signature of the person giving consent in the Register at the time of registration of the marriage;
- A consent document stating the names of the parties to the marriage and signed by the person giving consent;
- Verbal declaration before at least two witnesses in case of necessity. The consent having been given cannot be revoked.
Now that all the paperwork is done, it is time you moved on to the next stage, which is living the most memorable experience with your beloved one.
